Premise

The products purchased on www.birrificiodelsannio.it (hereinafter Birrificio del Sannio) are sold by Birrificio del Sannio s.a.s.with registered office in Via Rotabile Frasso-Melizzano, 26 82030 FRASSO TELESINO (BN).

1. CONTRACT

1.1 This contract relates to the purchase and sale of bottled beer in quantities and types chosen by the consumer by selecting the products on the website www.birrificiodelsannio.it.
The Customer acknowledges that the product offered for sale is a fermented alcoholic beverage as required by law and with the organoleptic characteristics shown on the label affixed to each bottle. The Customer acknowledges that the nature of the good and its alcohol content requires the consumer to follow normal rules of prudence and vigilance in its use.
The Customer acknowledges that the conservation of beers over time requires normal common sense precautions regarding the non-exposure of the product to intense light or high temperatures.
Birrificio del Sannio therefore recommends that customers take these precautions to maintain the quality of the product, obviously remaining unrelated to any degradation resulting from customer neglect.

To conclude the purchase contract for one or more products on www.birrificiodelsannio.it, it is necessary to fill in the order form in electronic format and send it, following the relative instructions, to Birrificio del Sannio. The order form contains the characteristics of each product ordered and the relative price.
1.2 The contract is concluded when Birrificio del Sannio s.a.s.receives the order electronically, after verifying the correctness of the relative data.
1.3 The order form will be filed in our database for the time necessary to process the orders and in any case in accordance with the law.

1.6 The user who connects to the site www.birrificiodelsannio.it is solely responsible for the use and contents of the site. Birrificio del Sannio s.a.s.cannot be held responsible for any use that does not comply with the regulations in force; in particular, the user will be solely responsible for the communication of incorrect or false information and data relating to third parties, without the latter having given their consent, as well as in consideration of incorrect use of the same.
1.7 The essential characteristics of the products are contained in each product sheet, while the images and colors may not fully correspond to the real ones due to the internet browser and the type of monitor used.

2. PAYMENTS

2.1 Two forms of payment are provided for the payment of products purchased on Birrificio del Sannio s.a.s.and related expenses: cash on delivery and credit card payment.

5. RIGHT OF WITHDRAWAL

5.1 You have the right to withdraw from the contract concluded with Birrificio del Sannio, without any penalty and without specifying the reason within ten (10) working days from the day of receipt of the purchased products. To withdraw from the contract, the return form must be used and the products must be returned to Birrificio del Sannio s.a.s.which must receive them within thirty working days, the only costs to be incurred are those of transport for the return.
5.2 The right of withdrawal is understood to be exercised correctly (in addition to compliance with the terms and methods described) when the following conditions are also fully met:

  • the return form must be correctly completed and sent to Birrificio del Sannio;
  • the products must not have been used, worn or damaged;
  • the label must still be attached to the products;
  • the products must be returned in their original packaging;
  • the returned products must be sent to Birrificio del Sannio s.a.s.in a single shipment;
  • Birrificio del Sannio s.a.s.must receive the products within thirty working days from the date of receipt by the user;
  • the products must be accompanied by a return slip.

5.3 If the right of withdrawal is exercised following the methods and terms indicated, Birrificio del Sannio s.a.s.will refund any sums already collected for the purchase of the products, net of shipping costs for the delivery of the purchased products.
5.4 The shipping costs will be refunded only if the withdrawal occurs for reasons attributable to Birrificio del Sannio, that is, in the event that the products do not possess the promised characteristics, have manufacturing defects or there have been errors in the delivery of the same.
5.5 The sums will be reimbursed as soon as possible and in any case within 30 days from the date on which Birrificio del Sannio s.a.s.became aware of the exercise of the right of withdrawal, upon notification by e-mail of acceptance of the withdrawal. If there is no correspondence between the recipient of the products and the person who made the payment, the refund will be made to the person who made the payment.

7. CHANGES AND UPDATES

8. SETTLEMENT OF DISPUTES

8.1 Italian law will be applied to any dispute deriving from the interpretation and execution of the contract and the General Terms of Sale, and the Court of Florence will have exclusive jurisdiction, with the exclusion of any other competing or alternative court.
If the Purchaser is based in a non-EU country, all disputes deriving from the contract and from the General Terms of Sale will be settled on a final basis by a board of one or more arbitrators according to the regulation of the Arbitration Chamber of Benevento at the Chamber of Commerce of Benevento.
The venue for the arbitration will be Florence.
